2nd Amendment

A well regulated Militia being necessary to the security of a free State the right of the people to keep and bear Arms, shall not be infringed.

In Daniel Websters 1828 Dictionary this is the meaning of Infringe:
INFRINGE, v.t. infrinj’. [L. infringo; in and frango,to break. See Break.]

1. To break, as contracts; to violate, either positively by contravention, or negatively by non-fulfillment or neglect of performance. A prince or a private person infringes an agreement or covenant by neglecting to perform its conditions, as well as by doing what is stipulated not to be done.

2. To break; to violate; to transgress; to neglect to fulfill or obey; as, to infringe a law.

The 2nd Amendment to the Constitution of the United States is quite clear, it specifically states: “shall not be infringed.” the folks who wrote it knew that it meant you were not to break, or violate, or any of the other ways in which you could negate this right. Without going into all of the ramifications of what is going on in our country right now, other than to state that the actions of some states have broken the covenant between the people and the government. The laws that the Federal politicians are trying to pass are also breaking the covenant they have with the people of this great land.

The 10th Amendment to this same Constitution states:
The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.

Since the 2nd Amendment does not grant any power to either the Federal Government, or to the State Governments, that indicates that neither the individual States, nor the Federal Government many “INFRINGE” upon the right of the people to keep and bear arms, only the people have that choice. They can choose not to carry arms, but they also cannot infringe upon the right of other people, who are equally sovereign persons, to carry.

I agree with laws that are aimed at keeping guns from the hands of convicted felons, and from persons who are mentally unstable, as witnessed to by a Doctor. I disagree with any law that attempts to take away my right as a law-abiding citizen of this nation to own and carry a gun. I live in a dangerous part of the country and believe that I need to be prepared to defend myself, my family and perhaps even those around me as neighbors and friends.

In addition to this of course is the rifle that I use for hunting, and that depends on what I am hunting. If I am after wild pig or deer, it is one rifle, if varmints it is another, snakes it is going to be a different one, usually a shotgun. So, my wife and I, each are hunters and when we are on the ranch to work animals we both like to carry a rifle and shotgun plus a handgun, because you never know what you might run into out there. All this is to say, don’t infringe on my right to be prepared to carry (bear) and use my guns.

Politics What Mess!

I read this story today: It is all about how the Democratic Party is going to spend millions to turn Texas into a Blue State. OK, they are going to do what they can to change the State of Texas, I think they may just make people angry, but, I could be wrong. The important things in our nation are not important to too many people, and so we have people concentrated on winning the next election instead of trying to get the House and Senate to begin actually doing what the Constitution says they are supposed to do. The House needs to pass a budget, the Senate needs to then discuss that budget, and make amendments to it and pass their version, sending it back to the House. Instead, the Senate is publishing their own budget, not looking at and discussing the one which is put forth by the House. The Constitution says that money bills are supposed to originate in the House, then go to the Senate. If they can’t agree then they are supposed to talk to one another and compromise. Instead there has been NO BUDGET in four years, because the Senate won’t even talk about what the House has passed.

Instead our politicians want to try to get advantage over each other, they begin to work toward re-election right after the election they just won. Politics are a Mess no matter who is in office, they all seem to be concerned with themselves and the people need to be hoodwinked into voting for them. More and more we find our rights, God-given rights, being abridged by these people not because they are trying to make things better, but because they think they will have a better chance to be re-elected.

Gun Control – 28th Amendment to the Constitution

Here is an idea straight out of Europe, Switzerland to be precise:

“Our 28th Amendment shall be:

In order to provide for the security of the individual, state and general wellbeing of the country, all able bodied individuals shall be required to own one modern firearm and a minimum of ten rounds of associated ammunition.

Individuals are required to receive training in marksmanship and operation of firearms. Military and law enforcement personnel shall be exempt from training if they have satisfactorily completed firearms training while in their course of their service.

Exceptions shall be made for those adjudicated mentally ill, convicted of a crime of domestic violence, a felony, or have been separated from the military with a Dishonorable Discharge.

Individuals that are fundamentally opposed to owning a firearm shall be taxed and each year shall register with the government as firearms objectors until age 62 or until proven by a medical doctor to be unable to operate a firearm.

If an individual is unable to purchase a firearm one shall be provided by the Federal Government.”

Read more: The Daily Caller, Now it seems to me that we are not really thinking about the issues surrounding Gun Control. You see, in our country, when we have a law that says you may not do this or that, law abiding citizens obey the law. Criminals do not obey the law, so when the Government decides to restrict or even take away my or your guns, then we law abiding citizens will normally go ahead and follow the law, while criminals will continue to buy guns. Not from legitimate dealers, but on the black market from other criminals.
So I hear the rhetoric that says we are just trying to make it harder for bad people to get and to use guns, but the truth is, well look at the murder rate in Chicago for instance. It has one of the strictest gun laws in the country, yet there were more gun related murders in the city than there were deaths of our troops in Afghanistan.
Oh and the ban on Assault Weapons – there is already a ban and it says the only persons who can own fully automatic weapons (assault weapons), are police and soldiers. NO LEGAL Gunshop will sell you one. If that is true, why do we need another law saying the same thing? Understand that politicians feel they need to do something so they can say see I tried to stop the use of assault weapons so no one else would be killed in a GUN FREE ZONE. That way they figure to be reelected so they can collect the pay raise they just got, and continue to give themselves raises every 2 – 4 years. Politicians don’t really care about “We the People”, they care only about themselves. They have become citizens of Washington DC and no longer have a clue about what goes on in your town or mine.
BTW there is a petition online https://petitions.whitehouse.gov/petition/project-amendment-28-require-firearms-ownership/swf6msdd check it out and if you think that the 28th amendment to the Constitution should be as outlined above sign the petition. It needs 100,000 signatures in order for someone to even bother with it.


Emotion Rules the Conversation

The more I see and hear about the conversation on guns and gun control issues, the more I see that emotion has taken charge. When a Senator says that we should put the National Guard in our schools, I know that she is not thinking, she is reacting emotionally to what has happened. Of course there are also the folks who say that NRA members should be shot, or they are the new KKK, which is patently outrageous, and of course there are also the folks who are saying that all guns should be taken away and no one should have a gun for any reason at all.

Somewhere in the middle of all the rhetoric, is where we need to be. Now let me say this, as a rancher in South Central Texas, just a few miles from the Mexican border and the violence that happens there on a regular basis, when I go out to feed our deer and other animals I go armed. We have had illegal persons caught on our ranch by the border patrol, some were armed some not, but the ones that were armed were smuggling drugs. They were more than willing to exchange bullets with the agents chasing them. The other side of that coin is wild animals that we may run into. Namely wild boar, Mexican Mountain lion, and of course the ubiquitous rattle snakes. So please get real about taking away my guns thank you.

So now that we have established a place where conversation can be held, let us look at what is going on here. A person who, legally could not own a firearm, stole them from his mother, killing her in the process. He then went to the school, shot out a window in order to bypass the security of the locked door, once inside he went to the school office where he killed the women inside, before going to the classroom. He then killed 20 children and their teacher, finally, killing himself.

Had there been just one person in that building who was armed, the picture might very well have been very different. I do not suggest that we put the Army or the National Guard in our schools, nor a police presence per se. What I do suggest is that we have those folks who are retired police/sheriff deputies/military who know about guns and how to safely use them. I would think that at least some of these are also grandparents of young kids and would be glad to volunteer to guard the schools that those children are in, even the schools that other children are in. I know that many teachers do not like or want to handle firearms, I don’t see why they should have to do so if that is their feeling in the matter. I know that I would be glad to volunteer my time one or two days a week to help protect our local schools. Of course you might want us to have an authority to answer to, say the local sheriff or Police Dept.

I think that would solve the problem, while costing next to nothing, you might want to feed us lunch, and of course you want to do a background check to be sure that none of those folks have any problems around children. Of course concealed carry, requires a background check, as does the purchase of a firearm. Let us understand too that we cannot stop people from doing crazy or stupid things, but we can stop them from doing these things in our schools.

One other thing I have heard a great deal about is the gun show loophole, supposedly you don’t have to have a background check if you buy a gun at a gun show. I have purchased guns at gun shows, every time I did I had to give ID and they did a background check on me. It is a requirement if you want to purchase a gun. What do you think about all this? The sad part is that as a member of the NRA, I am disappointed in Wayne La Pierre. His statements about placing police persons in the schools, does not take into account the reality of how thinly our Police Departments are already, and the cost of doing so is prohibitive for any Government entity to do. You are talking many millions, if not billions of dollars to accomplish this.

Cut Spending or Raise Taxes

That seems to be the Presidents plan, raise taxes and spending which is of course self-defeating. If you continue spending more than you take in, you will eventually go bankrupt, we realize that in our own homes because we see what overextension has done to our friends and neighbors. In my own case, it took me 8 years to pay off all my debts. I have friends that have had to declare bankruptcy, and they are still in a credit problem. Yet the Federal Government seems to think they can continue to spend more than they take in. If we don’t quit the spending, the country will find itself being cut again by the rating agencies. I cannot fathom why the President and the Democrats continue to insist on more spending and taxing people at the $250,000 per year income rate. They also keep saying these folks are millionaires. 1/4 of a million is not a million, I don’t know why the Administration continues to call them millionaires.

The other reality is that even if they do tax these “millionaires” they will only have enough money to cover 8 days of the gov’t operations. So when does the Federal Government get real and begin to actually tighten their own belts. Of course if they do, then they can’t offer all those handouts to all those who are now on the gov’t dole. I am not saying that folks really want to get on the payroll, but, some do and that means that they want to continue to get paid. Politicians want to get re-elected, ever notice that as soon as they get elected the cycle begins again, they are already running for the next election. The Senators actually make more money than you or I and they give themselves raises every couple of years. Most of these people leave the Senate or the House as millionaires themselves. Does that happen to you or me in our jobs? NO WAY! Can we spend money that we don’t have? Sure we can use our charge cards, but, how long can we go before it catches up to us and puts us in the midst of financial trouble.

How do you stop evil?

I keep hearing these talking heads discussing how you can make schools safe, and how can we stop people from doing this again. We have the same discussion every time someone does something evil, and it always seems to devolve to the choice of tool not the person.

We always want to do away with the tool, in this case guns, but there are those who then ask the obvious question, since more people are killed by drunk drivers than are killed by guns, should we then get rid of cars, or alcohol, or drugs. You see it is a vicious circle, the tool, is just that a tool. In the hands of a stable law-abiding citizen, the car, the drink, the gun are used properly. Let me say that I am an instructor in handgun use, and the first thing I teach is that we have to watch what we are doing with any tool. The handgun being a tool. 1. The gun is always loaded, do not pick up a gun thinking it is unloaded, please be sure that it is indeed not loaded. If you don’t know how to do this, DO NOT PICK UP THE GUN. 2. Never point a gun at anything you are not willing to shoot at, (some would say, destroy). If you have a gun in your hand make sure it is pointed downrange, or in a safe direction. Better yet, put it down or put it in your holster.

I was reading a piece earlier today that spoke about getting retired first responders, Police officers, Military personnel or others who have experience with firearms, to volunteer at your local school. Of course these would be armed persons, that would be able to at the very least slow down the assailant, and at the best stop that person before they could harm anyone inside the building or grounds. I would add persons who have qualified for concealed carry license, they have learned how to use a gun, they are licensed to carry and they have no criminal record. I know of a couple of people who would be glad to volunteer to protect the teachers and the especially the children in schools. It is a shame that there is a need to protect children in what should be the safe place for them, but our society has become somewhat coarsened over the last 50 years or so.

New gun laws, banning this or that gun, I note that a number of politicians and pundits keep referring to automatic weapons, these have been illegal for almost 50 years, what they are actually talking about are semi-automatic guns. You fire only one bullet when you pull the trigger, not a burst of bullets, just one. If you want to fire another you must pull the trigger again. Another thing that the politicians want to ban is the magazine that holds more than 10 rounds of ammunition. The problem there is simple, if I am out on my ranch, which just happens to be very close to the southern border of the USA, with Mexico. You don’t know what you will run into while feeding cattle or goats, or whatever it is you are raising. There can be anything out there from poachers, to human traffickers, to drug runners. All of them armed, now in the case of poachers, you probably will not have any real problem, but with the drug runners and human traffickers, you will be dealing with a number of guns looking back at you. I want to be able to protect myself with a decent amount of bullets that I can return fire with.

Some of these guys do have true assault weapons, so they can fire multiple rounds with one pull of the trigger. I can only hope that I can stop them before they end my life. So there are those of us who actually do need larger magazines. So let’s have a discussion that is not governed by emotion, or politics, but rather by common sense. First, lets talk about enforcing the law on the books now. Second, if you are going to have a school or place of business go into lockdown, then make sure that the bad guys can’t get past the locked door by shooting out a window and climbing in. Common Sense is a wonderful thing, and usually helps to being some decent ideas to the table.

Another hidden TAX

I just learned that there is a movement afoot in the state of Texas to charge five cents on every drink container sold in our state. Of course once you finish the drink you can bring it back to the store for a refund of your nickel. Well how about schools, they use tons of water bottles, Gatorade and other drinks, how do they handle the increased cost, and the return of those drink containers to get the refund? Maybe we need to hire a drink management team in each school just to handle that burden.

How about the store where you bought your bottle of water? How many extra man hours will they need to process all the refunds and what do they do with the containers when they get them back? How much is this going to increase our grocery bills? I found out the hard way somebody else told me about this, and I found out that my county is one of the ones that has decided to support this TAX. Our politicians never think about the unintended consequences of their actions. They just see another revenue stream for their pet projects. This is another Lottery Scheme. Remember that the State Lottery was supposed to help pay for education, the money was to be set aside for schools. It wasn’t and it goes into the general fund where it is used to fund whatever the politicians can find to use it for.

I did not support the lottery because it was legalized gambling and a tax on our poorest citizens. Instead of buying a loaf of bread, buy a lottery ticket instead, you could be a millionaire. That is the state looking for your dollars to spend on their pet projects instead of on the education of our children. This boondoggle is even worse, the nickel gets collected by the store, then whatever is left over at the end of the week or month or whatever the time period is, the money goes to the state, never to be seen again. A VERY SNEAKY TAX. You are told how you are protecting the environment, when in reality you are lining the pockets of politicians so they can institute more boondoggles.

Here is another thing they don’t think about, people will be stopping their cars to pick up the bottles and cans discarded by those who don’t care. Those folks who throw their beer cans, and drink containers out on the side of the road will continue to do so. This is a safety hazard, people may by killed or injured by other drivers who aren’t looking out as well as they should. This is a real problem and needs to be stopped before it gets the kind of momentum it needs. Talk to your representatives and your county commissioners, don’t let this TAX become a part of our Texas landscape.

What is the truth?

VP Joe Biden and Rep. Paul Ryan squared off yesterday in the one and only Vice-Presidential debate. It was interesting, but I thought that the way it was handled was stilted. I much preferred the more spirited debate structure, it was a real back and forth, of the Presidential debate. I thought I would go to Fact Check today to see what they had to say about the statements both men made. One that I found somewhat disturbing was the Fisker Automotive loan. The purpose of the loan was to push an electric car, and the money was to be spent in the US. So far so good, of course, not one vehicle was built-in this country, but, the money was spent on R&D, Advertising and other things all in this country. Ryan asked about the money in a way that suggested it was spent on cars being made in Finland, well according to financial statements from Fisker it was all spent here, however, the cars were not built here. What happens is that the funds given to the company were used here so that other funds could be freed up to build the vehicles in Finland. The total amount of funds so far paid to Fisker is $193 billion dollars, out of $595 billion authorized. They were supposed to begin actually building cars in Bidens state of Delaware in a closed down GM plant. That has not happened, and the government has cut off the funding to Fisker. So $193 billion taxpayer dollars gone down the Green Technology sinkhole, with nothing yet to show for it. Did the government fund workers in Finland, not directly, but I would say indirectly yes they did.
I also heard the Frank Luntz focus group last night complain that they didn’t hear any specifics from Ryan, yet he was very clear in saying that their 5 point plan was a starting point for discussions with both Republican and Democratic legislators to begin building legislation and budgets to move our country forward. cutting spending and lowering tax rates properly, while also cleaning up the tax code and getting rid of subsidies that corporations and individuals receive so that we could begin getting out of the mess we are in. Gov. Romney said basically the same thing in his debate with President Obama, yet, we still hear the cries of no specifics, give us specifics. I seem to remember that President Obama ran on Hope and Change, no specifics other than closing Gitmo (not done) and improving our relations in the world, (not done). He also said he would ban torture, that one he claims to have accomplished, he did ban waterboarding.
VP Biden also made the statement that Paul Ryan voted to fund two wars using the government credit card, of course he forgets that he voted for it too. These things always seem to get blown out of proportion, politicians do tend to exaggerate their claims and their good things, while trying to demonize their opponents. Of course one thing I found interesting was that VP Biden decided to double down on the claim that they, the Administration, did not receive any information on the need for increased security, nor did they receive information on the attack being a terrorist attack on the Consulate in Benghazi. Yet the hearings in Congress said that the State Department was following events on the ground in Benghazi by satellite with pictures and they knew that it was a terrorist attack immediately. They also knew that there were no demonstrations outside the consulate in real-time. So why did the Administration, including the Secretary of State continue for two weeks to make tha statements that it was all about the video. Is it true that State did not tell even Hillary Clinton the truth? PLEASE that begs to be refuted. There has been a terrible coverup in this murder of our personnel in Benghazi. The administration is culpable in the deaths of our personnel, they were asked for additional resources for security and they refused to deliver that help to the consulate. That is inexcusable.
So tell me, what do you think, has this latest debate changed your mind, do you think that one or the other of our candidates for office is better than the other, or do you want to hear more from President Obama and Gov. Romney?

Speaking of mothers

I am absolutely amazed at the statements of so many about stay at home mothers, my own mother was a stay at home mother until we 3 boys got old enough to take care of ourselves. She went out and got a job then and that was what she wanted to do. I have to admit it was nice to have her doing that, but you know, I also remember that my mother was the coach of our Baseball team. She also helped with our Soccer Team, and Football teams as well.
She was a working woman, whether y’all think so or not, you think it’s easy raising a family, managing the books (checking, savings, mortgage payments and what all), you think she didn’t know about finance? Hah, she had her degree in Business, she knew how to balance books and keep money from running out. She also knew that our government loved to spend taxpayer dollars on frivolity, then as now.
I find it extremely stupid of people who think that stay at home mothers don’t know anything, can’t do anything and should just shut up. I think it is time to clean house in Washington D. C. especially when it comes to Democrats and lobbyists. Fire them all, bring back the citizen legislator 2 terms and go back home to a real job.
This thing really has me riled up, my mother and father taught us to be responsible for our actions, but these people in Washington, want everybody else to be responsible for the mess they’ve made. Sorry but y’all can’t get away with it, you keep talking out of both sides of your mouth, and it is getting seen and understood by we the people. Please begin packing your bags, your time is almost up!

SCOTUS and Original Intent

As I listen to the political rhetoric I find myself becoming more upset with the politicians who claim to support the Constitution, and less sure of their reality. I wonder if these people have even read the Constitution of the United States.

Article III of the Constitution says that “The judicial Power of the United State, shall be vested in one Supremem Court and in such inferior Courts as the Congress may from time to time ordain and establish.” Under Section 2 we read this: “The judicial Power shall extend to all Cases, in Law and Equity, arising under the Constitution, the Laws of the United States, and Treaties made, or which shall be made, under their Authority; to all Cases affecting Ambassadors, other public Ministers and Consuls; to all Cases of admiralty and maritime Jurisdiction; to Controversies to which the United States shall be a Party; to Controversies between two or more States;” (see 11th Amendment for further case types). Further, “In all cases affecting Ambassadors, other public Ministers and Consuls, and those in whicha a State shall be Party, the Supreme Court shall have original Jurisdiction.” According to what this says the Supreme Court has Jurisdiction in Constitutional matters, and the Court must decide whether something before it passes Constitutional muster. There are of course other things that have affect in this, but the Constitution itself gives credence to the reality that the Supreme Court has Jurisdiction to decide the case before it.

I may not be a lawyer (thank heavens), but I can read, I can think things through and don’t need 100 pages of legal mumbo jumbo to tell me what is plain in the original text. So, if the Court decides that something is unconstitutional, then it is, it is not setting some kind of precedent for the Court to decide the case, either for or against the Government, even if the President thinks they don’t have the right. The Original Intent of the founders of this nation meant for the Supreme Court to be the final arbitrator of what is and is not Constitutional. We may not like what the decision is, but the legislature can always repeal or amend a statute, that is their job.

There are many statements in our Constitution that have been debased over the years by politicians and lawyers, it is time for the people of the these United States to read and understand for themselves what is and is not true. I hope that the Constitution will become required reading for all High School students in this nation. The Constitution is what framed our nation, and what keeps it together. Do not allow the politicians to continue to take away from we the People the power we hold by this document.
