Five Felony Counts?

There is a news story that really bothers me. A wounded Staff Sergeant with 10 years in the military, medically discharged and now working at Ft. Drum in New York State is arrested for possession of 5 magazines for his AR15 which he legally owned, but in New York State, under their old law, you could not have a magazine that would hold more than 10 rounds. Now if you did it was a FELONY now a magazine, that is empty, is just a magazine. Even if it was full of bullets it was still not going to hurt anyone, so, how could this be a felony?

Of course I left New York State in 1976 and have never looked back, it is a haven for leftists and socialists, and being a conservative it was hard to get work in that state. The only time I went back, I did so to bury my Dad and left as soon as possible after the funeral. New York is a depressing place, it is all gray and dingy, where I grew up is now all apartments and parking lots. Cement all over the place, even where we used to play stick ball is gone. The Church I used to attend as a kid growing up, now has an 8 foot high chain link fence around it and a locked gate. Why would anyone want to live in a place where even a church has to be locked behind a fence?

Now at the same time we have this “News” anchor, David Gregory, who knew he was breaking the law in Washington D. C. when he flashed a 30 round magazine on national TV. Of course they will not prosecute him, he is a “Star” and a “Newsman” so he is exempt from prosecution. A wounded veteran, a man who has had his license to carry taken away from him, even though he has not been convicted of any crime as of yet. The sheriff confiscated his handguns, he has sold everything he could so he could pay his legal bills, and they want to put this man in prison for having in his possession 5 magazines with no bullets. Now if he had those magazines on Ft. Drum, he would have been legal, but they arrested him with them as he tried to sell them. It doesn’t say how they knew he was doing that, or where it was that he was trying to sell them.

So, a war hero, wounded in action, and working for the Dept. of Defense as a civilian, is arrested and faces prison time, and if convicted will lose his job even if he doesn’t go to prison, but the suit the “Newsman” who sits behind a desk and reads the news, he can do as he pleases, even break the law and nothing will be done to him. So, isn’t it nice to live in the Socialist Republic of New York? Thank heavens I live in Texas where people are still free to pursue happiness, to carry (concealed of course) and to be able to protect themselves and their property. Of course we do have the Socialist City of Austin, but, we don’t have to go there so I guess it is OK as long as it stays there.

You would think that people would wake up and smell the coffee, that they would begin to see that the government is taking away their rights to be a free people. The Feds are constantly attacking the First Amendment, and ignoring the 10th. They want to put drones in our skies so they can track the movements of people to make sure we aren’t going to do something they don’t like. Our President acts more like a dictator ignoring the congress and ruling by executive orders. Janet Napolitano, Homeland Security Chief has stated that terrorists are those people who are veterans (military), or those who disagree with the government, and those who join the militia. Not only that but these people are stock piling ammunition they have ordered 1.6 billion rounds of hollow point bullets. Hello? What is that all about, WAKE UP AMERICA.

Drones over Texas

Hey Montgomery County check this out: “According to the ACLU, US law enforcement will, in the next few years, begin expanding its use of domestic drones for surveillance. ABC reports that the sheriff’s department in Montgomery County, Texas, for instance, already has a 50-pound ShadowHawk helicopter drone to back up its SWAT team. Although the department has not armed its drone, it can be equipped with a 40 mm grenade launcher and a 12-gauge shotgun. The prospect of armed drones patrolling the skies alarms Americans.

Obama has signed a new law to allow for drones to be used across the country. Many cities and colleges as well as law enforcement are signing up for the chance to use the civilian version of the military/CIA Drone in the United States. The FAA has been tasked to make up new rules understand that the use of these drones will impact every citizen in the country: “…drone use in the United States implicates serious privacy and civil liberties concerns. Although drones can be used for neutral, or even for positive purposes, drones are also capable of highly advanced and, in some cases, almost constant surveillance, and they can amass large amounts of data. Even the smallest drones can carry a host of surveillance equipment, from video cameras and thermal imaging to GPS tracking and cellphone eavesdropping tools. They can also be equipped with advanced forms of radar detection, license plate cameras, and facial recognition… surveillance tools, like the military’s… gigapixel technology capable of ‘tracking people and vehicles across an entire city.'”

Some folks are concerned enough to get up and out to protest the possible use of drones in their cities. The Homeland Security folks are already using drones on our border too, it wouldn’t take much to move them further into the country. They are talking about thousands of these drones flying around the country, and, I don’t know about you, but if we get an administration that decides they want to have control of the population, it wouldn’t take much to arm these things. Not my idea of good news. What do you think about all of this, are we fixing to turn the USA into a Police State?

Concealed Carry on College Campus

In Colorado, students have been able to carry guns on campus since 2012 so, there has been no bloodbath, as a matter of fact, no one really knew except the young people who were carrying. Now, however, the Democrats want to take that right away, and they have made some really BAD, one might even say STUPID arguments for taking this right away. Since there has been no outcry against these young women and men carrying guns on campus, and there has not been any evidence of negligence on the part of anyone why is it that Democrats want to take away this right?

One Democrat made the comment that a woman might think that she was in danger of being raped, and pull her gun out and shoot an innocent person. Why has this not happened before now? There are many situations where a woman may feel threatened, yet no one has been shot yet. How about this thought from Wisconsin; “University of Wisconsin Oshkosh police department posts “Tips for Preventing Sexual Assault” on its website. The “tips” include “passive resistance” strategies when faced with an attacker, like making yourself vomit or urinate, or faking an epileptic seizure.” Like a rapist is going to be put off by a woman peeing her pants, it will probably turn him on even more. Please people this is absolutely idiotic.

With 1 in 5 women college students suffering rape every year, which one of these people are going to be there to stop the rapist. Let’s be real, the cops can’t be everywhere there are not enough police to be able to do that, why is it that Democrats don’t want to allow women to protect themselves? Why can’t women have the RIGHT TO CHOOSE in this case like they can in other parts of their lives. It seems that the government wants to control every aspect of our lives, and they seem to think that they know better than you or I what is the best thing for us. They seem to want to micro manage your life and mine, and I don’t like it very much. No matter what they do, good people, law-abiding people will do what we have always done, we will try to work within the law. Bad people, criminals, don’t care about the law, they will continue to be criminals and that is where the government has NO CONTROL.

I like to be able to make my own decisions about my life and protection of myself and my wife. I think other people should have the same right to make decisions for themselves. The government needs to get the blazes out of our lives and let us live our lives as we want to.



Gun Control – Universal Background Check

The National Rifle Association has written an excellent letter to Congress in regard to the idea of Universal Background Checks. The NRA supports the National Criminal Instant Background Check System (NICS) and still does so. It is a good system, although terribly overloaded, primarily because the funds that were to support this system have not been appropriated to do so. In 1986 it became necessary for those engaged in the sale of firearms to possess a Federal Firearms License, (FFL). In addition it is necessary that all firearms sales through retail establishments namely sporting goods stores, Wal-Mart, and even Pawn Shops selling modern guns, must perform a background check on the person purchasing the gun.

Most purchases of guns happen through the retail venue, in other words, through licensed (FFL) dealers who perform (NICS) checks on the purchasers. The letter explains also that since 1968, it has been a federal felony for any private person to sell, trade, give, lend, rent or transfer a gun to a person he either knows or reasonably should know is not legally allowed to purchase or possess a firearm. A person may not sell or give to a person from another state or country a firearm, not even a shotgun, unless that person is a holder of a FFL in other words a licensed firearms dealer.

In addition, if I wanted to purchase a firearm from a dealer over the internet, or by mail order, I have to give that dealer the name and address of an FFL holder where I will go to pick up the gun. The dealer in my area will perform the background check and is legally allowed to charge a fee to me for that service.

Another fact that is overlooked in this discussion and is pointed out by the NRA, is that the law already prohibits sales to persons who are, felons; persons adjudicated mentally “defective” or involuntarily committed to mental institutions; fugitives from justice; dishonorably discharged from the military; illegal aliens and most non-immigrant aliens; unlawful users of controlled substances; persons who have renounced U. S. Citizenship; persons under certain restraining orders; and those who have been convicted of domestic violence misdemeanors. Of course it must be stated that NICS is only as good as its database. When States fail to transmit felony and mental health records to NICS, felons and the mentally incompetent fall through the cracks. Even though there is a requirement for this information to be disclosed to the NICS system, there are very large holes in the system. The General Accounting Office reports that as of 2011 23 states and the District of Columbia submitted less than 100 mental health records to NICS; 17 states submitted less than 10 mental health records to NICS; and four states submitted NONE!

There also needs to be a clean up of the database itself, the VA arbitrarily disqualified a number of veterans, who should not have been disqualified, then there are records that are incomplete or inaccurate, according to the Dept. of Justice Inspector General this is “a common occurrence”. Now, let us look at the claim that criminals obtain their firearms through gun shows. The evidence says NOT TRUE. A 1997 Bureau of Justice Statistics survey of state prison inmates who had used or possessed firearms in the course of their crimes found that 79 percent acquired their firearms from “street/illegal sources” or “friends or family.” This includes theft, black market purchases of stolen firearms, and straw purchases. Only 1.7 Pct. obtained firearms from anyone (dealer or non-dealer) at a gun show or flea market. Another survey in 2004 yielded nearly identical results. According to FBI records the average of firearms stolen between 2005 and 2010 was 232,400 firearms stolen each year. Therefore the methods of obtaining firearms by criminals are already illegal.

Just one other truth that is passed over in this discussion,if you offer false information on a NICS form, you commit a felony. In 2010 alone the FBI denied 72,659 NICS checks out of a total of 14,409,616 forms. However, only 62 of the 72,659 felonies were actually brought to trial, only 13 resulted in conviction. Why is that? According to Vice President Biden, it is that, “we simply don’t have the time or the manpower to prosecute everybody who lies on a form, that checks a wrong box, that answers a question inaccurately.” Now if I am someone who wants to beat the system I will try again elsewhere, since the government is not going to prosecute me.

So here we are with a system that needs to be fixed, yet, rather than working to fix the system we already have, and enforcing the laws already on the books, we are going to try to add onerous and unworkable fixes to society. Why does the government not work to make sure the current system is fully funded and working properly. I know that the NRA and gun owners in general would support cleaning up the database for NICS, and for enforcing the mandate that exists for states to report data to NICS.

One other fact that is missing in the discussion: If you want to purchase a fully automatic firearm, you must have the proper FFL, fully automatic guns are only authorized to be sold to the military, police, border patrol and other law enforcement departments. You or I cannot walk into a gun show, or a gun shop and purchase a fully automatic firearm. The “assault weapons” that the government seeks to ban, are semi automatic, not fully automatic firearms. You squeeze the trigger, one bullet is fired, you have to release the trigger and then squeeze it again to fire another bullet.

Where is the Press?

I haven’t seen or heard anyone even Fox news ask the questions that need to be asked. Here is an article written by Michael Porfido The questions really need to be asked, no one seems willing to challenge this President for the stuff he puts out. Saying that his programs will not add anything to the budget, with no cuts or new taxes to offset the costs that these programs will cost.

He talked about universal pre-school, that will cost literally billions of dollars, what is the offset. BTW science says that by 3rd grade there is no difference between kids who went to pre-school and those who didn’t. Why do we need this program? Another good one is the climate change nonsense. Saying that he wants bills to handle climate change, then says that if congress won’t do it he will act. He doesn’t have the Constitutional powers he seems to think he does.

Please read the article written by Mr. Porfido, he has put a lot of stuff out there for others to look at and maybe, if they are reporters, then they need to think about it and maybe in their shame they will actually do their jobs and ask the questions that need to be asked.

Losing our Freedoms?

I was reading on a blog written by Jan Morgan and it made me realize that we are in dire straits. We have been relinquishing our rights, so that we can gain security. However, security is not something that we have gained, our President was asked if drones would be used to kill Americans in our own land. He said that he had no plans to do so, however, that doesn’t mean that there are no plans. It only means that our President has not put forth any plans. Homeland Security is buying over a billion rounds of hollow point ammunition, what do you think that might be for? Target practice maybe? That happens to be enough to kill a lot of people, and BATFE as well as FBI agents have killed people in their homes, and then realized it was a mistake, they were in the wrong home.

I personally believe that our Government is beginning to plan on Martial Law, and a new Civil War, with them against the people. Power corrupts, and absolute power corrupts absolutely. I used to be a Republican, but I see that the Republicans are no different from the Democrats. I am now an independent, I believe in the Constitution, and I find myself more and more afraid of our Federal Government.

The Federal Government is already working with some of the States to put drones out there so they can use them for law enforcement purposes. Drones are used to kill people, that makes me wonder why we need drones in our own backyard. Who will be targeted? You know at one time Homeland Security said that Veterans, Militia members and people who complained against the government were a danger to our country. So are you a Veteran, I am, are you a militia member, I am and I have raised my voice against what I see is a weakening of our rights as American Citizens. What do you think about these issues? Is it just paranoia, or is there something we need to at least be concerned about?

Not Allowed to Arrest

It is nice that our Senators are finally coming to see that law enforcement, under this President, is only allowed to do its job when it is convenient for the President. Mr. Obama has signed an executive order that says that ICE cannot arrest people who have entered the country illegally unless they have committed murder, rape or some other felony. So we blame the man in charge of the ICE cops instead of blaming the man who has decided that he will only enforce those laws that he likes. As the chief executive of the country, he is tasked to enforce the law, if he doesn’t like it then he can go to Congress and tell them he wants them to change the law or abolish it, but he cannot pick and choose which laws to enforce and which ones to ignore.

If he was king, or emperor or maybe dictator then he could make his own laws but he is none of those things, he is instead President of the United States and must operate under the Constitution, which severely limits his power. Here is what the Constitution says are the powers granted to the President:
Article II: Section 2. The President shall be Commander-in-Chief of the Army and Navy of the United States, and of the Militia of the several States, when called into the actual Service of the United States.
He/she may require the Opinion in writing of the principal Officer in each of the executive Departments upon any Subject relating to the Duties of their respective Offices, and has the power to grant Reprieves and Pardons for Offenses against the United States, except in Cases of Impeachment.
He shall have power, by and with the Advice and Consent of the Senate, to make treaties, provided 2/3 of the Senators present concur; and he shall nominate, and by and with the Advice and Consent of the Senate shall appoint Ambassadors, other public Ministers and Consuls, Judges of the Supreme Court, and all other Officers of the United States, whose Appointments are not, herein otherwise provided for, and which shall be established by Law: but the Congress may by Law vest the Appointment of such inferior Officers, as they think proper, in the President alone, in the Courts of Law, or in the Heads of Departments.
The President shall have Power to fill up all Vacancies that may happen during the Recess of the Senate, by granting Commissions which shall expire at the End of their next Session.

Section 3 He shall from time to time give to the Congress Information of the State of the Union, and recommend to their Consideration such Measures as he shall judge necessary and expedient; he may, on extraordinary Occasions, convene both Houses, or either of them, and in Case of Disagreement between them, with Respect to the Time of Adjournment, he may adjourn them to such Time as he shall think proper; he shall receive ambassadors and other public Ministers; he shall take Care that the Laws be faithfully executed, and shall Commission all the Officers of the United States.

Section. 4. The President, Vice President and all civil Officers of the United States shall be removed from Office on Impeachment for, and Conviction of, Treason, Bribery or other high Crimes and Misdemeanors.

That is the extent of the powers of the President of the United States, note that the President cannot just willy nilly do as he pleases, nor can he by executive order nullify any law duly passed by the Congress of the United States. That power is not granted to the President.

It is a shame that We the People have forgotten our heritage, this President works for us, we elected him and he is not empowered to suppress any of us in any way. The Constitution does not give the President or the Congress the ability to run roughshod over the citizens of the country. They are tasked with certain duties and responsibilities, and no more. I shall begin writing on the Amendments to the Constitution simply because we the people seem to have forgotten our rights and privileges and it is high time we begin to take back our nation from these Career Politicians.

It is past time for we the people to get some back bone and begin to act as the free and sovereign people we are, instead of serfs under the boot of a dictator.

Wake up America, before you lose all that our forefathers fought to preserve!
